Situation with not getting my 10k miles

Ok so i just got off the phone with various capital ones representatives, all which gave me different answers. When i first signed up for my venture card (the 10k miles bonus points sounded attractive) only way to receive them was to spend 1k within the first 3 months, ok no problem, i did that. A couple of months pass and still i do not see the 10k points in my account. So i finally decide to call, i speak to one representative (sounds foreign) after me explaining my situation connects me to the "rewards department" which then i explain my situation to her. She then says "i see here that you have upgraded your account, so you're no longer eligible for those 10k miles". I then ask her why was i upgraded, i never gave the authorization for this. She proceeds to just say "i'm sorry about this, all i can do is give you 1500 miles" (by this time i'm losing my cool) so naturally i pick up my tone a bit, i then tell her if i was really upgraded the 1500 miles will rend me useless since the upgrade i was offered was a cash back card (which i refused a few days earlier). Which again she proceeds to say "im sorry i don't know what i can do for you". So i calmly say, "thank you for nothing and hang up.

I think to myself ok, not lets check when this change was made, i proceed to call again in hopes of a different representative, which i explain the situation to. He easily looks into it and say, no i don't see an upgrade here, so i ask him why i was told by one of his colleagues that i had an upgrade done. Now i don't know what to believe, is Cap one really trying to weasel me out of my miles?

And after this who situation the question i have (since it looks that i won't be seeing those miles) should i do the upgrade from my ventureone card, to this new quicksilver card they are offering me to upgrade to?

I would ditch Cap One and go somewhere with better CS. I have a card from them but I've never used it. I would not upgrade, I would cancel. If you really like the card you have with them, you could call back and threaten to cancel your card to try to get the miles you should've received.

You can sue them in small claims court for breach of contract.

You can always try the chat assistance via the CapOne website. It is often far better than the phone customer service.

Thank you very much, i just contacted them via email (with the email you provided me). Initially that was i tried, getting it fixed via chat on there cap one website, all they could do was provide me with a number... Either that or said "you have an upgrade".

Any decent, truly prime company would honor that bonus offer. If you met the criteria and didn't get it in a timely manner because of them being slow, they ought to make sure you get it, even if you did upgrade, but you say you didn't so they "upgraded" you without your approval.

Sounds to me like they owe you those miles, but you might have to fight like hell to get them from the sound of it. I agree with Robrus1, they are pathetic, let's be honest.

As far as threatening to close the account, a company like them will likely be delighted to see you go. Whenever I called up to cancel a card with them, the CSR was so happy to do so I had to assume they got a bonus for closing accounts and limiting Cap One's potential liability by 500 dollars. In truth though maybe that's not fair - maybe they were just happy they didn't have to make up nonsense trying to answer a question that their script didn't cover and they could just transfer you to someone else to get it done.

I can't see having a "prime" card with Cap One.

Sorry for the double post... So i got a call this morning and got this whole situation taken care of, i was able to speak to Bobby, who right away said "i'll add those points to your account right away". Just want to thank birthdayboy and everyone else for the advice.
