Lowes account

I have a family member who is being sued in small claims court by another family member who allowed them to use their Lowes credit card with the understanding they would pay for the item charged. There was no written agreement, no end date that the balance had to be paid back. Payment are being made but card owner now wants all the money paid in full and has filed a claim for it. What is the liability for the total balance to be paid back by the person who was allowed to use the card? Thank for any help.

Liability is completely on the owner of the account. Even if they had a written external agreement the account owner would be liable. The only instance where another could liable is if it is a joint account.

Chances are small claims won't do much either. Even if small claims judge says the other has to pay, no one enforces those judgments. This won't likely end in favor of the account owner unless the borrower has a change of heart and decides to pay.

I'm not a lawyer, but I did stay at a Holiday Inn Express last night... :cool:

Should have gifted the money, never expecting to be paid back and chalk it up to taking care of family. That's an ugly situation for all, sorry to hear of it.

To answer the question, the account holder is 100 percent liable. I'm surprised Small Claims didn't throw it out by now.
