    dmband,

I saw this piece yesterday by David Lazarus of the LA Times about old Capital One credit card debt coming back to haunt years later: http://www.latimes.com/business/la-f...,639051.column

Thanks for pointing that out. That's very interesting they say they're sending the bills because of a law passed but it's like they're just trying to trick you into paying the bill even though you may not be liable.

Default reply to original post and additional question

I have a debt from Capital One from when I was 18. I am 26 now getting ready to turn 27. They sued me way back when this first happened and they obtained a judgement for around $2,500 for a card that has a $200 limit (which is a crock on it's own)!

Over the last year the court they obtained a judgement from has sent 2 interrogatories trying to garnish my wages. Since I am the person that receives the mail (thank god) I said I don't work here! I am in the middle of filing bankruptcy and just waiting to get it paid off, I have no intentions on paying them to be honest, I could care less how bad that sounds.

I was 18 and you think you're getting over 10x as much as I originally owed you? No way! My question is and comment are one, this NEVER goes off your report mine is almost 10 years old and it's still there going strong and two, they have now sent a letter to my home about a court date coming up in march and it's just a card that says "garnishment hearing" and the date.

Do I have to go, what will happen if I don't?

And are they just trying to find out how they can get money from me? I mean they already obtained a judgment, they're just trying to figure out how they can rape whatever funds I have, right? Also if I go, should I mention I am in the process of filing? I don't have a bankruptcy number yet.
