Old collection company doing HARD PULLS

Postby Bay area Joe » Mon Sep 17, 2012 10:03 am

I have a collection bottom feeder company doing 2 hard pulls a year trying to collect a debt that is in excess of 10 years old.

The collection account and the original account are not even on my credit report as it has been well over 7 years.

How do I get them to stop making hard pulls every six months.

(800) 663-4707
Inquiry Type: Individual
Permissible Purpose: COLLECTION
Requested On: 03/25/2012, 09/27/2011

Help me please.......

Write them a letter explaining that they are outside of the statute of limitations and that it is illegal for them to continue collection action. Hard pulls constitute collection action. They can either cease and desist and remove the inquiries or feel the wrath of your lawyer and pay you $1000/per inquiry. Send it certified w/ return receipt.

Also, call the CRAs and dispute the inquiries.

Outside of statue of limitations just mean one cannot use legal action (lawsuit/judgement) to collect debt. CA can continue to attempt to collect debt, even outside of SOL.

They can try to collect on it, but they cannot continue to hard pull the OP's credit constantly I don't think that would be legal as they need a permissible purpose and once a debt has fallen off your reports it's not likely it would be legal to continue to hard pull that person over it. I'm not a lawyer, but I highly doubt what the bottom feeders are doing here is legal and the OP would be wise to get in touch with a NACA attorney to determine if the law has been violated, and if so to initiate legal action. Wouldn't it be ironic if he or she ends up being the one to get a judgement on the bottom feeders?
