Judgement and new application

Long story short..Discover was awarded a judgement against me over eight years ago. I still owe on the judgement. No job on the books or bank account so they are unable to garnish. I was injured and unable to make money and now I'm back so I intend to pay. In Fl statute of limitations is 5 years so the judgement is off my credit report. A few months ago I got my first credit card in years. Now all the sudden I have been getting pre approved discover card the same company that sued me. Is that normal practice? I'm building my credit back so I would like the card, just don't know what to do. Thank you.

I think you need to get a copy of your credit reports and see what is on them. Most things stick around for 10 years so you might still have a few to go. There is a possibility that repaying it will reset the 10 year timer. So even if it is the right thing to do morally, it might not be the right thing to do financially.

There have been a few people on MyFico in a similar situation. They burn a creditor and a few years later start getting pre-qualified offers. Just remember, those letters we sent to people by a computer. You probably have the type of file they want, but if you really did burn them, they might not care to have you back.

I did get my credit report about 5 months ago.that judgement was off the report in February. A few months after is when I started getting the applications. I just find it odd that a company that sued me and got a judgement would send me apps. Like you said it's a computer sending it so if it sees my credit score is good then it auto send it.Thank you for your reply.

I would suggest not responding and or applying to Discover for 5 more years. As I noticed in a pervious post someone mention you may start the timer all over and then you will have a negative mark on your CR.

It would be wise for you to not respond to anything like that UNTIL you've paid off that judgement. If they see you are actively applying for credit they may decide it's worth pursuing you for the money so I would take care of that before you do anything else credit wise.

And yes sometimes the left hand doesn't know what the right hand is doing in corporate America. That happens a LOT. Doesn't mean they are going to give you a card - they might, but my best guess is it will take you longer than that to get back in with them.
