    Default Question on postmarked mailing dates for credit card bill.

    I put my credit card bill into a drop box on Sept 6, 2010, which is a usps holiday. Would the postmarked date than not have to be Sept 7? Due fact that it would of been in before the Sept 7, pick up date. Is it possible to make the CC company prove the postmarked date?

    I don't think most credit card agreements even take into account postmarked mailing dates when a bill is sent it. Most say the payment has to be received by 5 pm on the due date.

    Mogul is right. They usually say it has to be received by a certain date so the postmark is irrelevant.

    But, I have gotten out of a late charge once because my state has a law that says anything mailed in the USPS is automatically assumed to be received 5 days after it is mailed. Since the payment was mailed to a processing center within my state I argued that the state law applied and threatened to challenge the charge with state regulators. They waived the charge very quickly.

    I have no idea if I would have won a challenge but it certainly would have been a hassle for them to fight it.

    My advice would be to ask that any late fees be removed and to know the law that applies. It's a long shot but if you are a valuable customer they might do it.

    I didn't know that, I wonder what other states have similar laws. One problem I could see with proving that is that I would imagine their payment processing facilities discard the envelopes with the date printed on them and without the envelope, wouldn't it turn into a your word against theirs?
