Credit Fraud advice

Postby thegameksk » Thu Aug 29, 2013 3:13 pm

Hello. I had various acts of Fraud commuted under my name in the past. The majority of them were when I was a minor and a fake job was giving along with a fake birth date. In 2007 I had a lawyer get my record cleaned or so I thought. I received a call today from a bill collector about an account I "had" back in 2001. I had never heard of this account but he said I owed 13,000 for it and a judgement was placed against me back in 2005 again which I had no knowledge of. He said soon a lein will be placed on me. So what can I do to fight this? I think it is the same case with whoever committed this giving a fake job and a fake birth-date. Regardless he told me its mine and I need to pay. Since my credit was cleaned up I have followed my 3 scores monthly and no where on my credit report is anything having to do with this account or a lien. Can anyone please give me advice? Thanks.

Go to the court where the judgment was issued and file a motion to set aside the judgment. Explain what happened and why it has taken you so long. Let the lawyer come in to court and prove that you actually opened the account.

I am going to court next week. In this case, how long before the bill collector can garnish my wages? Also in New York what is the SOL of civil judgments? Ive heard 8 and 10 years? I had a friend who is a lawyer tell me 8 but online when I searched it says 10. If its 8, this would have expired already.

I don't know NY law. In Colorado, it depends on whether it's a county or district court judgment; 6 years for the former, 20 for the latter, infinitely renewable.

I am going to court tomorrow. I spoke today with someone from the bill collectors office. I wanted to know when what dob and occupation were giving on original credit card. The response was if your social was right your dob was right. I said no before I had fraud under my name with the right social and wrong dob/occupation. He didnt want to give the answer and we were going back and forth. At what point he said who cares. He then said it was my correct bday but idk if he just said this or if it actually were. The judgement was passed in 05 and ive never seen it on my credit report. Even right now it says no judgments have been passed against me. So my question is this how do I go about fighting this in court?
