Got damaged item, can I dispute the charge?

I bought a item via the internet and used my Bank of America credit card. The item was over $1,000 and when it arrived it wasnt what I ordered. The item was damaged.

Contacted the merchant and was told...tough luck. So I opened a dispute and was wondering what everyone's thoughts were?

Will Bank of America help me? Whats my odds?

This actually sounds like a textbook example of how a chargeback would work. I'd encourage you to try and read your credit card agreement because they always have a section that is dedicated to this type of scenario. Just make sure you don't pay for the charge in the meantime and I'd say that you have a pretty good chance of this working out for you.

FWIW I charged back a Gin and Tonic once. It wasn't about the money, it was about sending a message.

I would try a chargeback/dispute. But it will depend on how the item is damaged. If it was damaged in shipping you might have to file a claim with the shipper. Also, if you have a premium card they will help you out a lot more than if you just have a basic card. In my experience AMEX will bend over backwards to help you but the basic cards from the big issuers will usually side with the merchant. They will ask you if you ordered an item from the merchant and if you received an item. If you did then they will determine that the purchase is valid and side with the merchant. It will be up to you to work with the merchant over damages or an incorrect item.

What did you buy? How was it damaged? was it actually an incorrect item or was it just broken?

I bought a rifle and when it arrived it had alot of visible scratches and blemishes. It looked used.
