Never received order from international/foreign merchant

I purchased some items for a gift from an international website using the USA bank credit card. They accepted the payment with no problems. The shipping and billing address that I indicated was the "gift address outside USA" because I purchased it as a birthday gift.

Now after more than 30 days, nothing arrived there so I emailed them and asked to track the item.

They replied "unfortunately we ship items with regular airmail without a tracking number - we have only a proof of posting but not a delivery confirmation or a real tracking"

So I asked for a refund and they replied "you agreed our term and conditions (TOS) and you agreed that shipping damage, loss or any other problems with shipping are a customers, clients responsibility ,and not the merchant" (something similar)

They have a terms and conditions that customers have to accept. I obviously accepted (because there is no other choise) but can I still dispute this purchase and file a charge-back?

Call your bank. The merchant has to accept the credit card issuer's terms in order to accept the card, and those terms are often heavily in favor of the customer.
