Merchant Suing in Small Claims Court after Losing Dispute

I have read that merchants that try to recoup their losses by suing customers in small claims court to regain chargeback monies after AE ruled against them in a customer dispute violates the Merchant Agreement they signed with AE. However, I cant find the specific reference and I am in this situation.

I filed a dispute against a business for a charge for services not performed, I won and the charge was reversed however now the business is suing me in small claims court just to harrasse me

Does anyone have the specific clause in the AE Merchant Agreement in which Businesses agree to abide by AE decision re chargebacks?

page 49, 11.5; Resubmission of a disputed charge: Merchants must not re-submit a Disputed Charge after it has been resolved in favor of the Cardmember.


Nothing there about suing... but it does suggest their decision is final, and that merchants should not take their own actions to reverse a chargeback.

I would gladly g to court and face the small merchant that tried that stunt.

Would also likely find some loophole to exploit so I can counter sue them and make money on the deal

I truly hate crooked merchants and will even if it means I spend money try and teach them buggers a lesson

NOW just t be clear, I would only do this IF I know I am right and not doing it to make money when I know I'm offside.
