You're wrong about the taxes. They might pocket the money and never declare it, but on their year end W2 the employer still has to enter something in the tips income box. Throughout the year a waiter's sales will be totalled and a certain % of those sales will be computed as tips received and entered in the tips income box.
Guess when this became effective? - in the 1980s - when Ronald Reagan was President, who cut the taxes for the rich and powerful, and had to get those funds back somehow. Typical Republican, line the pockets of the rich, but bleed the poor.
